Course Objective

The subject of this course is to inform students attending the course from different disciplines on damage and hazards that occur during disasters, to raise awareness of them about what to do before disaster strikes, to provide awareness about pre-disaster and post disaster actions that constitute crime in terms of Criminal Law, to provide information about what actions require responsibility before and after disaster in Criminal Law, to clarify about what are the sanctions imposed on responsible for the subjects stated in Criminal Laws, to fully reveal source and nature of responsibility imposed on state, natural people and legal entities determining the ones who have criminal responsibility.

1   To be able to gain information about the concept of disaster in terms of Criminal Law
2   To be able to be awareness about pre-disaster and post-disaster actions that constitute crime in terms of Criminal Law
3   To gain information about people who have criminal responsibilities in disasters
4   To gain awareness about responsibility of natural people and legal entities during disaster
5   To have information about legislation that brings criminal responsibility
6   To gain information about responsibility of those who have responsibilities in this area and actions that constitute crime in terms of Criminal Law

2 Determination of responsible people during and after disaster in Criminal Law
3 Detection of responsible people and shape of their responsibilities
4 Examination of legislation that bring criminal responsibility generally
5 Regulations brought by Turkish Criminal Code about responsibility in natural disasters
6 Regulations brought by special laws about responsibility in natural disasters
7 Criminal responsibility for human-made disasters
8 State responsibility for terrorism acts
9 Criminal responsibility of individuals for terrorism acts
10 State Responsibility in disasters generally
11 Revealing criminal responsibility from disaster in framework of ECHR
12 Presentation and discussion of students semester assignments
13 Presentation and discussion of students semester assignments
14 Presentation and discussion of students semester assignments

Articles, reports, books and theses about disaster administration, criminal responsibilities of administrators, criminal responsibilities of legal entities, crimes that may occur during, before or after disaster.

Planned Learning Activities and Teaching Methods

Theoretical knowledge transfer;
Presentation of study subjects by students in a participatory and debating way in line with the identified themes;
Literature and field research necessary for students work;
Examples of Supreme Court decisions and evaluations and debates on ECHR decisions.
