Course Objective

The purpose of this course is to give students the hardware on non-navigational uses of tranboundary waters in international law particularly in relation to the EU acquis.

Learning Outcomes of the Course Unit

1   To be able to explain the concepts on the non-navigational uses of transboundary waters
2   To be able to analyze the scope and limits of the right of non-navigational uses of transboundary waters
3   To be able to analyze the principle of equitable and reasonable utilization as an emerging principle on non-navigational uses of transboundary waters
4   To be able to analyze the principle of prohibition to harm as an emerging principle on non-navigational uses of transboundary waters,
5   To be able to discuss national and international jurisprudence on the non-navigational uses of transboundary waters
6   To be able to interpret the developments, works of codification on the non-navigational uses of transboundary waters.

1 The history and legal development of non-navigational uses of transboundary waters
2 The concepts related to non-navigational uses of transboundary waters I (Shared Waters, International Rivers, Shared Natural Resources, International Waters System, International River-Drainage Basin)
3 The concepts related to non-navigational uses of transboundary waters II (International Watercourses, Transboundary Waters)
4 The concept of the right of non-navigational uses of transboundary waters, its legal basis, the situation of sovereignty rights
5 The principle of equitable and reasonable utilization as an emerging principle on non-navigational uses of transboundary waters (its meaning, scope and legal basis)
6 The principle of equitable and reasonable utilization as an emerging principle on non-navigational uses of transboundary waters (its relationship with the principle of prohibition to harm and the rules of procedure)
7 Legal Regime of Transboundary Waters in Turkey (The arrangements among Greece, Bulgaria, Iran and Turkey)
8 Exam
9 Legal Regime of Transboundary Waters in Turkey (Regulations among Iraq, Syria and Turkey/ Güneydoğu Anadolu Project)
