Course Objective

The basic aim of the Juvenile Law Course is the acquisition of the essentials of the subject; namely it aims to examine the position of the juveniles in law, their rights and obligations in the family and society, legal protection of the juveniles.

Learning Outcomes of the Course Unit

1   To be able to define the basic concepts related to the Juvenile Law (child, adult, adulthood, apprentices, etc.).
2   To be able to relate the basic principles of the Juvenile Law (principles like the superiority of the juvenile's interest) with other law branches (Constitutional Law, Tort Law, Civil and Criminal Procedures) and with different legal disputes
3   To be able to give the right decision on what rules to apply in cases related to the Juvenile Law.
4   To be able to apply the Juvenile Law rules and the rights and obligations of the juveniles related to the Private Law to particular cases.
5   To be able to assess the current legislations related to the Juvenile Law in order to offer new solutions to probable legal shortcomings.

1 General Information on Juvenile Law: (Concept of being infant and adult, purpose of the protection of children, Meaning and importance of Child/juvenile Rights)
2 Sources regulating the Childrens Rights: Childrens Rights and their protection in International Legal Regulations (UN Convention on Child Rights, Declaration of Child Rights, European Convention on the Usage of Child Rights)
3 Fundamental principles of Juvenile Law in the Light of International Regulations
4 Sources regulating the Childrens Rights: National Regulations on on Childrens Rights and Protection of the Child Constitution, Turkish Civil Code, Turkish Criminal Code Criminal Procedings Code, Code on the Protection of Child Code of Controlled Liberty, Aid Centers and Protection, Labour Act.
5 Child's Rights in the Constitution (Fundamental rights and principles)
6 The legal position and the rights of the child in terms of Civil Law in general
7 Child's capacity of having rights and legal capacity
8 Mid-Term Exam
9 Protection of the child's personality
10 Personal position of the child
11 Relations between the Child and his/her parents I.Familial Kinship
12 II.Parental rights (Rights and obligations of the father and/or mother who holds the parental right, legal representation of the child, child's property).
13 III.Child's property and its protection
14 Protection of the child by way of tutelage
