Course Objective

This course aims to research problems that come up due to innovation in technology and
usage of computer, and those related with law of proof. This course especially aims
concept of electronic signature and its usage to be learned and qualification of
documents created in electronic media regarding proof rules of law of proof by
discussing.

Learning Outcomes of the Course Unit

1   Ability to explain concept of electronic signature and electronic sertificate.
2   Ability to produce solutions to problems of proof stamming from electronic trade and electronic contracts.
3   Ability to produce solutions to problems of proof run into regargding consumer transactions made by in electronic banking and electronic media.
4   Ability to set forth difference between proof value of electronic documents and proof value of documents with electronic signature in area of civil procedure
5   Ability to evaluate electronic documents and documents with electronic signature as proof in concrete dispute.

Course Contents

1 Concept of electronic document.
2 Concept of electronic signature and document with electronic signature, types of electronic signature.
3 Electronic sertificate and practices related with creating electronic signature in computer.
4 Electronic sertificate service provider and its responsibility.
5 Evaluation of qualificated electronic sertificate and time stamp as proof.
6 Usage of foreign electronic sertificate as proof.
7 Problems of proof run into in electronic banking.
8 Midterm exam
9 Problems of proof run into in electronic trade.
10 Problems of proof stamming from electronic contracts and electronic sale contracts.
11 Problems of proof run into by consumers in transactions made in electronic media.
12 Place of electronic documents in system of proof and evidence value of electronic documents.
13 Evidence value of documents with electronic signature.
14 Evaluation of Electronic Signature Act numbered 5070 and secondary regulations and regarding of Electronic Signature Act numbered 5070 and related legal regulations with regard to comparative law.
