Course Objective

The purpose of this lecture is, to introduce the margins of the criminal law from the human rights perspective.

Learning Outcomes of the Course Unit

1   Being able to express the relationship of the human rights and the criminal law
2   Being able to express the position of the main principles of the criminal law before the human rights theory
3   Being able to digest the structure and the judicial system of the ECHR
4   Being able to determine the fundamental rights protected by the offences in TCC
5   Being able to compare the intervention by the TCJC and TCC to the intervention by the ECHR

6 Art. 5 of the ECHR, Freedom of the individuals and the Criminal Law
7 Art. 6 of the ECHR, Right to fair trail and the criminal procedural law
8 Art. 7 of the ECHR, the principle of lawfullness and the criminal law
9 Art. 8 of the ECHR, protection of the private life and the criminal law
10 Art. 9-10 of the ECHR, freedom of expression and the criminal law
11 Art. 11 of the ECHR, freedom of assembly and the organisation and the criminal law
12 Art. 14 of the ECHR, prohibition of the discrimination and the criminal law
