Course Objective

The basic aim of the Juvenile Law Course is the acquisition of the essentials of the subject; namely it aims to examine the position of the juveniles in law, their rights and obligations in the family and society, legal protection of the juveniles, to present the necessity of the juvenile criminal law and the differences of this area from other criminal areas and to examine the criminal law regulations related to this special area.

Learning Outcomes of the Course Unit

1   To be able to possess the basic concepts related to the Juvenile Law (child, adult, adulthood, apprentices, etc.) and the main domestic and international documents related to the juvenile criminal law, the minority regulations in the TCC as a condition effecting the ability to defect and the security measures special to the juveniles in the juvenile protection act.
2   To be able to relate the basic principles of the Juvenile Law (principles like the superiority of the juvenile's interest) with other law branches (Constitutional Law, Tort Law, Civil and Criminal Procedures) and with different legal disputes.
3   To be able to assess the current legislations on what rules to apply in cases related to the Juvenile Law in order to offer new solutions to probable legal shortcomings.
4   To be able to apply the Juvenile Law rules and the rights and obligations of the juveniles related to the Private Law to particular cases in consideration of the principles of juvenile judgement.
5   Being able to evaluate the juvenile delinquency in terms of criminology and the speciality of the execution of the punishments fort he juveniles.

1 General Information on Juvenile Law: (Concept of being infant and adult, purpose of the protection of children, meaning and importance of Child/juvenile Rights) Sources regulating the Childrens Rights: National Regulations on on Childrens Rights and Protection of the Child Constitution, Turkish Civil Code, Turkish Criminal Code Criminal Procedings Code...
2 Fundamental principles of Juvenile Law in the Light of International Regulations and Child's Rights in the Constitution (Fundamental rights and principles).
3 The legal position and the rights of the child in terms of Civil Law in general Child's capacity of having rights and legal capacity
4 Protection of the child's personality-Personal position of the child
5 Relations between the Child and his/her parents I.Familial Kinship II.Parental rights (Rights and obligations of the father and/or mother who holds the parental right, legal representation of the child, child's property)
6 Protection of Child's property and Protection of the child by way of tutelage
7 Juvenile rules in the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (Beijing Rules) and in the other international documents European Convention on the use of the rights of the children
8 The terms of criminal child and the children driven to crime- The minority regulations in the TCC as a condition effecting the ability to defect
9 Protective and supportive measures avaliable to the children
10 Juvenile Court , The investigation and the prosecution at the children judgement (statement taking, custody, detention, trial activities etc.)
11 Crimes against children in the TCC (sexual abuse of children, miss of children, detain of children etc.)
12 Juvenile delinquency in terms of criminology
