Course Objective

To identificate the extend of intellectual and industrial property notion; to learn how to protect the intellectual property rights of beneficiaries in the meaning of material and moral way; the meanings of brand, patent and industrual design and the difference of these notions from other similar notions; the scope of the protection and to penetrate the legal compilation solutions if an encroachment is occured.

Learning Outcomes of the Course Unit

1   To have a good command of the notions and the agencies about the Intellectual and industrial Proporty Law
2   To be able to describe the notions of Intellectual and industrialProperty Law and to identify the scopes of it.
3   To be able to teach the sources of the lecture
4   To follow, research and analyse the scientifical works, positive law and the jurisprudences about the lesson.
5   To procure following current affairs about the lesson.
6   To generate a solution to the problem that is met in implementation about the lecture with the basic knowledge.
7   To be able to analyse the intangible and tangible matters about the lecture.
8   To inhance the ability of generating solutions lecture doctrinal problems.

Course Contents

Week Subject Description
1 Introduction to the lecture, suggesting the reference books that can be useful, the notion of Intellectual and industrial Property, the difference of the Intellectual Property from the tool, that it comes into being, the organizational structure.
2 The notion of work (production), sorts of productions processings,collected Works. The rights of author, Suits for damages andcriminal suits.
3 The notion of brand, the sorts of brand. To elicit and record the brand. The legal effects and consequences of brand registration.
4 The legal obstacle of brand registration. The reasons of peremptory and comperative challenges. The legitimate brands, in the meaning of Paris Pact.
5 The protection and scope of brand. The legal obligation of using brand.
6 The position of brand as a legal transaction. The brand licence. The invalidity of brand and the dissolution of trademark.
7 The notion of invention and the conditions of patent licence. The inventor and the rights of inventor. The lawsuits that can be brought if the patent rights are violated.
8 The application to the patent licence, the examination of the application from the point of subscription right. To grant a patent and the procedure of granting patent. The lines of patent and the legal patent obligation.
9 The protection that the patent licence gives. The rights which is given by patent licence and the limitations of these rights. To prevent the indirect usage of patent.
10 The obligatory licence at patent law. The position of the patent and licence application as a legal transaction. The invalidity of patent and the dissolution of patent rights. The lawsuits that can be brought because of violations.
11 The notion of industrial design. The protection of industial desing. Right to design. The deforcement of industrial design rights and the lawsuits. The porsedure of registration, novation and demurral.
