Course Objective

To examine basic subjects of Islamic Legal Methodology; to recognize classical and
modern literature on the subject; to generate some contemporary legal comments of these
methodologies by considering all these historical developments and experiences.

1   They have knowledge about birth and development of Islamic Legal Methodology
2   They understand where does the legal methodology comes from
3   They learn how to analyze the legal judgment
4   When they encounter a legal problem, they have the capacity to know whether it has a connection to the legal verses.
5   They learn contemporary explanation of legal issues

3 Sunnah, its place in methodology, and categorization of hadith.
4 Ijma, Legal Consensus and its types.
5 Kiyas, Legal Reasoning and its types
6 Secondary Sources (Adillat al-Fariyya): Words of the Companions, Isdtihsan (regarding beautiful), Maslahat
7 Judgments from the sources of Islamic Law, al-Hukm al-wadî, al-Hukm al-Taklifi
8 Midterm Exam
9 Hass, Âmm, Mushtarak and Muawwal
10 Haqiqah, Majaz, Sarîh and Kinayah
