Course Objective

It is aimed to research general theory of constitutional law, different sides of state, democracy, basic rights and freedoms, government systems.

Learning Outcomes of the Course Unit

1   Being able to determine constitution and constitutional law 2   Being able to explain the conditions of making and changing law 3   Being able to discuss about the elements and theories of the origin of state 4   Being able to define the concept of government system 5   Being able to explain different meanings of democracy

Course Contents

Week Subject Description 1 The concept of law, constitutional law, sources of constitutional law. 2 General theory of constitutional law, quality of political power, constitution-politics relations. 3 Definition of state, political power, constitution as social contract. 4 Constitution movements, institutionalization of regimes of modern and traditional society types. 5 Relations and differences between constitutions and the other laws. 6 Types of constitutions. 7 Difference of constitutional state and state with constitution; relation between this difference and political power, rulers and ruled. 8 Midterm 9 Midterm 10 Making and changing constitution, methods of changing rigid constitutions. 11 Types of fundamental and derivative power: Constituent assembly, plebiscite, chosen constituent assembly. 12 Suitability of laws to constitution and constitutional jurisdiction. 13 State system according to constitution: Monarchy- republic according to legislation-executive and jurisdiction. 14 General outlook to Turkish constitutional developments.
