Course Objective

Evaluation of work permit of foreigners within the scope of validity of freedom of labor and labor contract, analysis of permit procedure and permit types, determination of authority and responsibility of administration.

Learning Outcomes of the Course Unit

1   To analyze statute law about work permits of foreigners.
2   To explain administrative and judicial remedies.
3   To discuss scientific opinions and precedents critically.
4   To explain types, scope and exemption conditions of work permits.
5   To prepare and present seminar works conformed with academic standards.
6   To present solutions about problems in practice.

Course Contents

Week Subject Description
1 Scope of Law about work permit of foreigners and basic definitions.
2 Obligation of receiving permission and authority of giving permission; application authorities, form of application and permission.
3 Working permissions; temporary and permanent permissions, independent work permit.
4 Exemption and limitations of work permit.
5 Giving and prolonging permissions, condition of children and wife of foreigners.
6 Exceptional cases, the people who are married with Turkish citizen, resident foreigners, the people losing Turkish citizenship, citizens of EU member states, key personnel, people under the scope of settlement law, foreign teachers.
7 Midterm
8 Rejection reasons of permission system; cancel of work permit, no longer existing of permission, application to the court.
9 The conditions of foreigners who are in illegal status foreseen by international agreements.
10 Notification liability of employers and foreigners working independently, audit authority and criminal sanctions
11 Effects of permissions on validity of employment contract and application problems; Membership of foreigners in relevant professional organizations.
12 Making foreigners work in foreign capital investments, employment in liaison offices.
13 Permission request of official institutions, giving permission, its time and extension. End of permission, receiving it and case reviews.
14 Final Exam

Theoretic explanation focusing on procedural, basic and judicial conditions of legislation provisions. Analysis of reference precedents. Examination and discussion of studies presented by students.
