Course Objective

The aim of this course is to enable students to understand the basic concepts and principles of obligations law. The course also aims to create the logic of the obligations law. In this context, the place of the rules of law in the rules of social order; the concepts of law and jus; legal event; the concepts of legal transactions; the sources of law and hierarchy of sources; compulsory, complimentary and interpretative legal rules; gap-filling, interpretation and discretionary power of the judge; the role of good faith in the acquisition of rights; good faith; law of persons; personality concept, the beginning and the ending of personality; natural and legal persons; competence of jus and legal act; family law; inheritance law; law of property; judicial system; civil and criminal jurisdiction; administrative jurisdiction and constitutional jurisdiction issues will be discussed.

Learning Outcomes of the Course Unit

1   Students will be able to learn fundamental concepts of the obligations law.
2   Students will be able to understand deptor-creditor relationship and origins of obligation and to explain discharge of debts.
3   Students will be able to learn the establishment of the contact and discharge of debts and the results of non-performance of obligation.
4   Students will be able to learn tort liability.
5   Students will be able to learn the concept of unjust enrichment.
6   Students will be able to explain the termination of the debts and its results.

2 Obligation and the sources of deptor-creditor relationship, notion of responsibility
3 Deptor-creditor relationships arising from legal transactions and contract, subject and establishment of the contract.
4 The principle of freedom of contract
5 Validation conditions of contract
6 Form of contracts and interpretation of contracts, Standardized terms and control
7 Mid-term exam
8 Mid-term exam
9 Incompatibility between will and declaration of will.
10 Agency and agency without authority in obligations law
11 The concept of tort and cases of liability based on fault.
12 Cases of strict liability
13 Unjust enrichment
14 Discharge of debts and default of debtor.
