Course Objective

Having knowledge about regulations of Trade Law in international plan, national regulations, also international uniform works and its organizations. Comprehending the relation between international commercial agreement samples and individual international commercial contracts. Having knowledge about incoterms, international sales, EU Competition Law, International Land Transport Law, generally having informed in several significant issues in international field, such as international payment formats, L/C contracts, franchise, leasing, forfaiting contracts.

Learning Outcomes of the Course Unit

1   1. Comprehending national regulations in International Trade Law, neccesity of uniform configurations and its reasons, importance of international agreements in this field.
2   Evaluating what should be remarked for avoiding legal desputes while the parties settle international commercial contracts liberally, in accordance with freewill, importance and results of attributing incoterm clauses in international sales incontracts.
3   Evaluating norms and principles of international sales.Recognizing UN Agreement s executiong area which applied ininternational sales field, its regulations, solutions.
4   Distinguishing international commercial contract types,interpreting the species, parties, and provisions of maincontracts; discernmenting international regulations whichshould be applied or not in contracts.
5   Comprehending and interpreting the norms and principles of EU Competetion Law which references national regulations in Turkish Law.

Course Contents

Week Subject Description
1 The work of unification on international trade law and the work by international establishments fort his purpose; especially the importance of being a party to multilateral international aggrements regulating international trade.
2 Conditions which oftenly located into the international sales contracts. Meaning of freedom will and the importance of INCOTERMS, purpose, history, editing.
3 INCOTERMS 2010 Revision.
4 Separately to examine incoterms clauses, Interpretation of CIF and FOB Clauses which frequently used in the contract of sale,analysis of case studies.
5 Overall ratings of the UN Convention on the International Sale of Goods ( CISG) , field of application of the agreement,
6 According to the UN Convention on the International Sale of Goods, delivery of goods, delivery of goods in accordance with the contract, transition of damage , contrary system to the contracts.
7 Overview of the EU Competition Law-ABIDA- 101 Treaty on the Functioning of the European Union Article Investigation ( limiting the prohibition of competition), case studies.
8 ABIDA 102 Treaty on the Functioning of the European Union Article Investigation ( Prohibition of abuse of dominant position) and case studies.
9 Intellectual Property Law, international regulations especially regarding patents and trademarks
10 Comparing studies on factoring and forfeiting contracts, franchise agreements, the nature of the contract, subject, the rights and obligations of the parties, the termination of the contract.
11 The agreements of the contract of carriage of goods by road 1956 ( CMR). Field of application of the agreement, the transport document, the carrier s liability, states which removes the responsibility, case studies.
12 Forms of international payments especially the credit agreement
