Course Objective

Discussing, interpreting and presenting the status of the sources of international law in national legal systems, the implementation of these sources and the status of the sources of international law in Turkish legal order, in theory, national practices and jurisprudence.

Learning Outcomes of the Course Unit

1   To be able to explain the sources of international law
2   To be able to explain the position of the sources of international law in various legal systems
3   To be able to evaluate the status of the sources of international law in Turkish Law
4   To be able to analyze the status of the sources of international law in national legal orders in the light of national and international jurisprudence
5   To be able to propose solutions to problems related to the implementation of the sources of international law

2 Theories on the relationship between international law and national law
3 Sources of international law
4 The status of treaties in Turkish Law
5 The hierarchical position of the rules of international law in Turkish Law
6 The direct applicability of the rules of international law in Turkish Law
7 The characteristics of international texts applicable in the national order
8 Exam
9 The effect of translation errors on the direct application of treaties
10 The position of the unratified international texts in Turkish Law
11 The control of international rules (before and after ratification)
12 The legal effect of non-binding engagements
13 Evaluation of international jurisprudence and reports on the status and implementation of rules of international law in national legal orders
14 Evaluation of national jurisprudence on the position and implementation of t rules of international law in national legal orders
