Course Objective

The general provisions of the marriage that are located in the between articles 185-201 of the Turkish Civil Code will be examined with concerned legislation and judgment. The Aim of this course is to teach these provisions and to assess of these provisions by comparing with regulations of some foreign legal systems.

Learning Outcomes of the Course Unit

1   Be able to perceive the general provisions of the unity of marriage in the light of judicial decisions.
2   Be able to evaluate the general provisions of the unity of marriage with a critical perspective.
3   Be able to compare the general provisions of the unity of marriage with the legislations that are in foreign systems.
4   Be able to reveal whether or not matching of the general provisions of the unity of marriage with the structure of the Turkish family.
5   Be able to produce solutions for applicability of the general provisions of the unity of marriage and to provide a control about the implementation of these provisions.

2 The general assessment about mutual rights and obligations of spouses
3 The family name of women
4 The management of the unity of the marriage
5 The representation of the unity of the marriage according to application area
6 The representation of the unity of the marriage according to operation
7 The legal actions of the spouses
8 Midterm Exam
9 Joining to the expenses of the unity of the marriage (The detection of the expenses of the unity)
10 Joining to the expenses of the unity of the marriage (The sanction of the noncompliance with the sharing of the costs of the unity)
11 The home of the family (The obligation of spouses to live together, exceptions of that) (The selection and the provision of the home of the family )
12 The legal transactions in relation to the home of the family
13 The protection of the family The conservation of the unity of the marriage under the provisions of the law on the prevention of the violence against the women
14 The conservation of the unity of the marriage under the provisions of the civil code The general evaluation

Planned Learning Activities and Teaching Methods

Students will research about issues that are identified at the beginning of the period, and will prepare seminars. Immediately after the presentations of the seminar the instructor will summarize the issue by own perspective . After the discussions will be carried out with the participation of all students.
