Course Objective

It is aimed to teach basic principles of the law of discipline and investigation procedure.

Learning Outcomes of the Course Unit

1   To explain concept of discipline.
2   To ascertain difference of discipline sanction from other kind of sanctions.
3   To explain disciplinary proceedings.
4   To interpret basic principles valid for disciplinary proceedings.
5   To analyse judgments of European Court of Human Rights related to the disciplinary sanctions.

2 The improvement process of the law of discipline
3 The resources of the law of discipline
4 Types of discipline: Democratic, autocratic discipline.
5 Non-judicial punishment types ( Instructors, rulers, prosecutors)
6 Non-judicial punishment types in civil service and applications
7 The role of non-judicial punishments in administrative act theory.
8 Midterm
9 Evaluation of non-judicial punishments in terms of administrative act elements
10 Method in discipline law
11 Investigation period in discipline applications.
12 Procedural guaranties in discipline law
13 Discipline regime in terms of procedural law and substantive law.
14 Disciplinary penalties within the framework of European Court of Human Rights
