Course Objective

In this course, the type of intellectual property rights, their conceptual explanation with examples, within the framework of the procedure of registration and legal protection in Turkey are examined. In particular, trademark, patent, utility model, industrial design as well as industrial property rights also know-how and computer software from the protection of the related license agreements and intellectual property-competition law relationship in the context of technology transfer issues are discussed.

Learning Outcomes of the Course Unit

1   Intellectual property rights and the types of elements to distinguish conceptually from each other, to assess the differences.
2   To have information about the current registration procedure in Turkey on Intellectual property rights, especially trademarks, patents and industrial design.
3   To understand the Intellectual property rights and know-how un-attacks against the violations that occurred in what ways; and the case is protected with.
4   To understand and interpret the place and the way in which computer programs in intellectual property law that is protected.
5   To evaluate the causes and the consequences of the of the importance of technology transfer agreements and these agreements in terms of competition law under Intellectual property rights and know-how.

Course Contents

1 Introduction to intellectual property law, intellectual property concept, especially in the field of international agreements on property rights which Turkey is a party
2 Trademark Law, Trademark can be registered as marks in Turkey Trademark Registration, Registration obstacles
3 The protection of trademark rights, invalidity of trademark rights and termination of trademark.
4 Patent Law; the concept of invention and the patentability requirements, patent application and patent granting; patent and utility model comparison.
5 Types of patents and the obligation of patents; invalidation of the patent and the end of the patent right.
6 Protection of patent rights, the case-suits that can be asked patent rights lawsuits in the case of rape.
7 Law of industrial design, industrial design concepts and types; protection conditions; design right; registration of industrial designs
8 Know-how (technical and commercial information) concept, the law nature of the know-how, protection of know-how, know-how agreements
9 Software in the intellectual property law, the protection of computer programs
10 License agreements, especially brand, patent-license agreements and industrial design.
11 Intellectual property law and competition law relationship; competition law rules in the field of intellectual property law implementation.
12 The concept of technology transfer, the EU Competition Law in the assessment of technology transfer agreements, the EU Commission's new (to enter into force on 05.01.2014) of the Block Exemption Regulation on Technology Transfer Agreements related to a comparative assessment
13 New (to enter into force on 01.05.2014) Agreement on Transfer of Technology Block Exemption Regulation and examination of the details and the articles
14 Case Studies under the light of EU Commission and the Court's decisions.
